If you get an "Unable to verify referring url. Please go back and try again" error when you try to log in, you need to be sure you are accessing the board with a url that starts with "https://ecauldron.com".  If it starts with https://www.ecauldron.com" (or "http://www.ecauldron.com") you will get this error because "www.ecauldron.com" is not technically the same website as "ecauldron.com". Moving to the more secure "https" means it is more picky about such things.

Damn, if DOMA gets completely nuked, I'll be amazed.

I hope that your Marriage Penalty tax won't be too high. I heard one tax woman on Yahoo state that she's asking her clients, especially those that make a ton of money, to file now because your going to be hit big time.

Actually, if I could be married for federal purposes to my wife, I'll save a bunch of money on taxes and insurance.

In my experience, the vast majority of people benefit financially from being married.

But DOMA isn't going away even if they rule that section three is unconstitutional. They have to fully repeal the law for it to go away. Just my two-cents. Of course the outcome will only affect states that allow gay marriage and not stated that don't. I was trying to ask the Professor on Yahoo chat about that and he had to leave and do something called work. I can't wait to have him back on Yahoo chat after DOMA arguments are finished.

"The Professor"? Maybe you could ask Gilligan and the Skipper while he's busy?

The Supreme Court can and does strike down parts of laws as unconstitutional. It happens pretty regularly. For example, they struck down parts of this AZ immigration law.

Personally, and this is off-topic, I really want to know what the court is going to do in the case of the Indian girl, who is part of my great-grandmother's tribe, that is now living with her Indian father after her non-Indian mother gave her up for adoption and used text messages between her and the father to prove that the father didn't want the baby. Such a sweet little baby and so sad that people care more about themselves then a sweet little angel from above.

That is so off-topic I have no idea why you even brought it up. I'm not familiar with custody cases in India so I don't have an opinion on that one. Maybe you can make a thread about it?

Probably a professor of law, but name and insitution would be nice.

and the second is probably a Native American custody case, although I suspect it isn't just the custody, it's the electronic communications involved, again, I'd have to find it.

I just saw this tweet from Scotusblog:

YES! YES! YES!

:D :D

You beat me to it, Lokabrenna; I could have saved myself the typing!

(And I also echo your YES! YES! YES!)
The first song sets the wheel in motion / The second is a song of love / The third song tells of Her devotion / The fourth cries joy from the sky above
The fifth song binds our fate to silence / and bids us live each moment well / The sixth unleashes rage and violence / The seventh song has truth to tell
The last song echoes through the ages / to ask its question all night long / And close the circle on these pages / These, the metamythos songs

It can't get completely nuked, because the folks bringing this case very wisely sought only to challenge Section 3 of the law--the part about the Federal government not recognizing same-sex marriages and denying benefits. They knew that if they challenged the part of DOMA that says other states don't have to recognize SSMs--which, if it fell, would effectively make SSM legal nationwide--they wouldn't win, because SCOTUS isn't ready to impose SSM nationwide...as we seem to have seen over the last 2 days.

--The states rights argument, which carries great weight with many of the conservative justices, clearly favors dumping DOMA Section 3

--If the Supremes really want to let the "experiment in the states" continue, as they seemed to suggest yesterday, it's hard to see how allowing the Federal government to tip the scales in that experiment is permissable or desirable

It will be interesting to see what pretzel logic positions Scalia will contort himself into on this one, while his sidekick Uncle Thomas sits there silently like an Oreo-flavored lump of dubious nutritional value.

A States Rights will hurt liberals more than conservatives.  Striking DOMA Sec 3 down will probably be a split opinion - lots of support to strike it down (7-2, 8-1, I think 9-0 would be a bit much) but at least 3 different opinions on why to do so.

I wouldn't be surprised if at least 1 liberal votes to up hold DOMA Sec 3.

Scalia would put his arm through a meat grinder before he would render any decision in favor of same-sex marriage.

On a related note - Nora (Morphidae) just forwarded this to me - it's a speech by a NY State Senator back when they were debating making it legal there

No one said "but the children!" when I went through years of homophobic bullying that only ended when I got a boyfriend. No one said "but the children!" when I heard bigotry and hate spewed from my church's pulpit at a young age and learned to hate my budding attraction to girls. No one said "but the children!" when my high school English class -- under the auspices of the teacher -- stopped and talked about why homosexuality was wrong for forty-five minutes (as long as I could stand it before running off to another teacher's room in tears).

Apparently to these folks, my childhood innocence is worth jack shit because I'm gay.
Maker, though the darkness comes upon me,
I shall embrace the light. I shall weather the storm.
I shall endure.
What you have created, no one can tear asunder.

Uh, I don't think so.

If the proponents of Prop 8 don't have standing that quashes the 9th Circus ruling.  Personally, I think the Court is leery of creating another Roe v Wade type case. They don't want to deal with 40 or more years of cases on the issue and would rather let the political system continue to make it legal.

It's a win for the two couples who fought to get married, but that ruling doesn't extend beyond them. Every other couple that want's to get married has to go to court and get it's own ruling.

I heard that those that make over a million dollars is going to pay a huge marriage penalty. Here's a interesting article about taxes and gay marriage.
