Other than I suspect you don't need a new law, it's a pretty good tactic.  I suspect that the Federal HHS Secretary could issue a regulation to the same effect without additional enabling legislation beyond the power granted under Obamcare.

I don't think the idea is to actually pass the law, but to show the opponents of access to birth control for the hypocrites they usually are.
