I love the bit about the Virginia voters having approved it from the bishop. I guess the idea that the US Constitution trumps a state constitution is foreign to him.

my guess is that in certain parts of the country, we could get the voters to outlaw the catholic church too. Hey, the voters in X County approved it, what's his fuss?

It annoys me greatly that many news outlets have one URL for a story when it first breaks, then change the URL a few days later for archiving. But it wasn't hard to find the new one.

I expect their verdict on CA's Prop 8 to be 5-4. I refuse to predict which way. Roberts will be the swing vote in either case, and we'll know by who writes the opinion which way it went before they announce the verdict. Unless it's Roberts. I wish I could trust the Supremes, too.

Wait, I'm confused. CA's Prop 8 is dead and gone; SCOTUS booted the case for lack of standing on the part of the plaintiffs, over a year ago, in a 5-4 decision written by Roberts; in that regard, your expectation is established history.

It is becoming increasingly difficult, though certainly not impossible, for SCOTUS to reverse all the decisions striking down same-sex marriage bans. There have been so many, from so many different parts of the country, from such a wide variety of judges, and with clear legal argumentation to support striking down the bans. They know which way the wind is blowing.

Scalia will rail in dissent, Thomas will nod silently in agreement (or perhaps in a fit of sleep), and the rest will break down into a 6-3 or 5-4 result in favor of SSM.

The real question is whether the conservative justices, in a subsequent case, will prevail in throwing their Religious Right compadres a Hobby Lobby-style lifeline that will carve out a religious exemption to discriminate against gay people--an exemption that doesn't exist for any other protected class.

Gah, you're right. I thought they still had a SSM case waiting to be heard. I guess we'll just have to see which state's case gets there first. I still expect a real decision to be 5-4, but that's an easy call with how they've been these days.

It's good to see the Old Dominion moving out of the 18th century which it seemed to be stuck in for well over two hundred years. Now if Virginia could be like Colorado and Washington state things would be a lot more happier, especially with Pat Robertson protege, Tea Party Bob McDonnell and henchmen out of the picture. Not to overly trounce upon my former big boss's integrity, but Virginia doesn't need these type of jerk wads as leading government officials.
