"A new bill filed by Oklahoma State Rep. Todd Russ. House Bill 1125 would  bar judges and other public officials from solemnizing marriages.  Marriage licenses would have to be approved by a clergy person."

BTW, a clergy person is either a rabbi or authorized by their denomination to "preach the gospel".

So many things wrong with this, including the logic (e.g., conflating "spiritual" with "religious", particularly with organized religion of the type that would have someone who can legally perform marriages).

My favorite is the part where the sponsor of the bill says people who don't want a religious marriage can file an affidavit of common law marriage (which, in some jurisdictions takes several years to establish legally, as opposed to a brief ceremony), but the news article points out that Oklahoma doesn't recognize common law marriages.

The thing I genuinely don't get about this sort of person is how they miss the bit where trying to establish a particular religious standard for a civil contract automatically removes it from the sort of thing that can be done with a civil contract.

I mean, usually they're subtler about the "the only people I want able to make this civil contract are the ones who adhere to my religious principles regarding it" thing than that, which leads me to suspect that at least some of that lot are aware that if they come straight out and say 'I only want the state to recognise things according to my religion' the state is more likely to actually say 'Sorry, Constitutionally forbidden' without it having to go to court.  But this?  This blatant?  Wow.

I don't think logic (or basic constitutional law) are this guy's strong points.

As Randall suggests above, a lot of people who make it into legislatures aren't the brightest bulbs intellectually.
