Teen sexting prosecution prompts outrage

God damn. They're going to try to wreck his whole life over this? That's- that's evil. And they've forcibly taken pictures of his penis?

I can't imagine being violated like that. I actually hope they prosecute the prosecutor on some sort of rape charge, because that's exactly what it sounds like.

Now, now if two consenting adults behind closed doors (Bill and Monica) cannot get away with it, what chance do teenagers have, for just looking?

As for the 5th is there an minimum age to invoke it :sick:?

Well, I'm a bit confused about the age of consent in Virginia then. Don't they usually exempt minors who are within a certain age range of each other from these sorts of laws, such as statutory rape, etc.? I'd think that being only 2 years apart would fall within that range.

Problem is that it isn't about statutory rape, but about the creation and spread of child porn - no actual age exemptions on that, to my knowledge.

Upon further googling, it would seem that Virginia indeed does not have any additional parameters on age related to sexting or child pornography.

Lesson being if you're under 18 and want to see each others' naughty bits, do it the old fashioned way (in my case, in the back room while grandma is off taking her midday nap).

Yeah, that blows my mind too. Teens can show each other their sexy bits in person to their hearts' content, but send each other a picture of said sexy bits and it's suddenly a felony that will follow them the rest of their life.

Well, actually, no. If you get busy in person as teenagers and get caught, and either person's (or both) parents decided to press charges then it's also a felony; ie. statutory rape.

This depends on the state. Where I grew up there is a limitation to this provided that both teens are within a certain age range of each other (I believe it's 3 years), but the law gets more complicated depending on the exact ages involved. Apparently in Virginia as long as they are both between 15-17, it's not a crime, but if he is 18 and she is 16, he might get a misdemeanor.
